exercises in public relations than statements of fact.
The memo describing the relationship between the US Dept
of Commerce and ICANN is available at:

It is actually styled in the form of a project agreement
for ICANN to continue to develop an industry cooperative
organization and processes, rather than an acknowledgement
or transfer of responsibilities or authority. In theory,
at the end of the project, the responsibilities could be
transferred to another organization.
This was done because of widespread dissatisfaction with
the present institutional features of ICANN, the apparent
reluctance of ICANN to be responsive to concerns expressed
over the past two months or to be fully accurate in its
representations, and the realization that an extend
evolutionary process was needed. Rather than rejecting
ICANN, it gives it an opportunity to learn and adapt
to being an open, trusted cooperative organization.
This approach is actually rather elegant, a testimony to
the wisdom and innovation of the public officials involved,
and very much in the Internet tradition of consensus and
trust building.
It also underscores an opportunity for the Asia-Pacific
Community to remain involved and itself play a role in
shaping this organization through the various activities
that will ensue under the agreement.
