The Menace of Cybersquatting! by Rodney D. Ryder & Ashwin Madhavan [The Icfai University Journal of Intellectual Property Rights]
Abstract: The advent of technologies has brought many complexities. The World Wide Web and domain names are the contributions of technological development during the recent past. The new tech-inventions have resulted in various issues of the intellectual property rights and their protection. The relations between the domain name and copyrights on one hand and the trademarks on the other, are well envisaged and an opinion is cropping up whether the use of marks in the name and style of domain names are diluting the trademarks. The World Wide Web or the cyberspace is becoming a platform for squatting activities resulting in loss to the copyright and trademark owners. Though the World Intellectual Property Organization (WIPO) and ICANN are trying to resolve the related disputes, they are not able to avert the squatting and provide required protection.

Safeguarding freedom of expression remains the challenge
The title of the ministerial conference the Council of Europe held this week in Reykjavik – “A new notion of media?” - raises an important question: do new media or media-like services really exist? Are they really “new”?

Public Comment: IRT Final Report on Trademark Protection in New gTLDs
The Implementation Recommendation Team (IRT) posted its Final Report on Trademark Protection in New gTLDs. The IRT (Members of the IRT are listed here [PDF, 88K]) was formed by ICANN's Intellectual Property Constituency in accordance with the 6 March, 2009 ICANN Board resolution (http://www.icann.org/en/minutes/resolutions-06mar09.htm). The resolution was in response to the request by the community seeking solutions for potential issues for trademark holders in the implementation of new gTLDs. The team reflects experiential and geographic diversity and is comprised of 18 members and two alternates.

GAC Responds to Board on Geographic Names
On 26 May 2009, the GAC submitted a final letter [PDF, 72K] responding to the ICANN Board's concerns about the ability to implement the provisions of article 2 of the GAC Principles regarding new gTLDs, particularly paragraph 2.71. The letter recommends, as a minimum, that the names contained in three internationally recognised lists must be reserved at the second level at no cost to governments of all new gTLDs. However, other issues relating to geographic names at the top level and the potential misuse of the respective names at the second level requires further discussion.

Applicant Guidebook: Public Comments Analysis and Revised Excerpts
The second version of the Applicant Guidebook for new generic top-level domains (gTLDs) generated continued public interest, as expressed by over 200 comments received.

New Registrar Contract Approved by Board
A wide range of amendments have been approved to the contract that defines the rules for the retail level of the Internet's domain name system. The set of 17 amendments to the Registrar Accreditation Agreement (RAA) were agreed to unanimously by the ICANN Board on 21 May 2009 and follow an extensive consultation that engaged all interested elements of the Internet community including governments, individual Internet users, and gTLD registrars.

ICANN Expense Analysis: by Stakeholder Interest Area
As one important element of transparency and accountability, ICANN strives to publish meaningful, accessible financial and operational information. Through its history, ICANN has consistently increased its financial reporting. Within the last 24 months, for example, ICANN developed monthly dashboard reporting on financial data. Earlier this year, the dashboard started to provide financial information by primary functions.

Boucher Schedules ICANN Hearing
House Energy and Commerce Communications Subcommittee Chairman Rick Boucher, D-Va., will hold a June 4 hearing to examine the future of the U.S. government's relationship with ICANN. Subcommittee staffers will be briefed on the topic a day earlier, sources told Tech Daily Dose on Thursday. A witness list has not yet been finalized. Boucher has previously expressed interest in holding an ICANN hearing, particularly since a joint project agreement that has allowed Commerce Department oversight of ICANN is slated to sunset on Sept. 30 amid accountability and transparency concerns.

ICANN and Trademark Maximalism (Again) by Milton Mueller
When ICANN passed a policy to create many new top level domains, both free expression advocates and trademark owners squawked (but for different reasons). ICANNs Board ignored the free expression advocates and rewarded the trademark owners by passing a resolution authorizing the formation of an Implementation Recommendation Team (IRT).

Editorial: Why I’m Opposed to New Top Level Domains
It’s no secret that I’m generally opposed to introducing new top level domain names. And I’m not alone. Even before people started talking about a mass introduction of new TLDs, most of the domain name industry was opposed to new TLDs. I’ve asked the question on every Domain Name Wire survey for the past four years, and the no’s always beat the yes’.

Will ICANN Drop Its Biggest Revolutionary New Idea? Five Reasons
ICANN, the Internet Authority is up against the wall, and here are the top five reasons for which it may simply drop its greatest revolutionary idea of offering a brand new type of a designer domain name to fit the next generation of widely expanded Internet and cyber realities of tomorrow. This new proposed platform will surely revolutionize the marketing and branding for big and small businesses around the world, offering highly affordable tools for global reach than ever before but the strong opposition would like to kill this idea. Would ICANN consider dropping the idea? Here are the five reasons:

Twitter Founders Say They’re In for the Long Haul
... The founders also suggested that for a fee they would embrace the challenge of trying to authenticate a company or person’s identity. “If you are Dunkin’ Donuts, you have a brand to protect and want to make sure no one else is pretending to be Dunkin’ Donuts,” Mr. Williams said. (Perhaps they should talk to ICANN, which has been mediating the inevitable trademark disputes in domain names for years.)

IRT Report Delayed as Original UDRP Drafter Weighs in Critically
The final Report of the Implementation Recommendation Team (IRT) created by ICANN to propose trademark “solutions” for new gTLDs was due on Sunday, May 24th. We checked the IRT home page over the last three days but could find not find it, but did hear through the grapevine that it had been delayed.

gTLDs and MALICIOUS USE OF DOMAIN NAMES
By now, interested people are aware that ICANN intends to allow an unlimited number of new top-level names, intended to rival the existing gTLDs such as .com, .net, .org, .biz, .travel, .jobs, etc. Many of these will be internationalized domain names (”IDNs”) in scripts currently unavailable at the top-level of the DNS, such as Arabic, Chinese, Cyrillic, Hebrew, Hindi, Korean and Japanese. ICANN also intends to allow new IDN country-code TLDs, for example “.India” in Hindi script, to supplement the current ASCII versions like .co.uk, .cn, .de, .in, etc.

The global success of the Britain's Got Talent star has had an unlikely impact on one unassuming Texas artist. ... Next, she started getting calls and emails from people wanting to buy her website's domain name. "One guy, within a minute, had increased his offer from $100 to $500,000. I'm not sure how serious he was, but that sort of thing is very strange to happen to someone like me." She consulted a company called Sedo that sells domain names and, following their advice, has now put her web address up for sale for a cool $25,000. She hasn't sold it. Yet. Apache remains firmly in the lead, having gained 3.3 million sites, and Microsoft-IIS remains second, having lost almost 0.9 million (mostly due to less activity seen at accounts on Microsoft's own Live Spaces service). QQ.com, the popular IM service in China, remains third with 29M sites. Google takes fourth place, after gaining approximately 1.5 million sites, and remains ahead of nginx which gained 200,000.
