ICANN Can: Contracts and Porn Sites - Choosing 'to Play Internet Ball in American Cyberspace' by Cheryl B. Preston & Brent A. Little [Pacific McGeorge Global Business & Development Law Journal]
Abstract: We argue in this article that the history and structure of ICANN illustrates that, despite its claims to the contrary, ICANN does now make and implement policy in non-technical areas of Internet governance. This article examines how ICANN-imposed obligations within the Domain Name System (DNS) have been used to implement those policy objectives. Efforts at protecting children from age-inappropriate sexually explicit material online should be as important a policy for ICANN as is protecting the economic value of big corporations trademarks. Terms within ICANN's Uniform Domain-name Dispute-resolution Policy (UDRP) can be meaningfully engaged in helping countries carry out reasonable pornography regulation. This approach does not require radical changes in law or structure; instead, it enables governments to enforce Internet pornography and obscenity laws that have been difficult to enforce because of the Internet's borderless nature. This Article
 describes how UDRP language, and the even more extensive language adopted by many ICANN-authorized registrars, registries and Internet service providers, gives the legal basis for removing Internet sites that violate the law. We then detail how this approach can be implemented in the United States under existing rules on jurisdiction and the reach of injunctions.

Abstract: ... Seventh, Congress may include in a pornography regulation a provision similar to that in the Cybersquatting statute, which further facilitates broad international enforcement. Eighth, the architecture of the Internet and the popularity of top level domains administered in the United States present various options for U.S. Courts to require the removal from the Internet of content that is in violation of U.S. laws, even if served offshore. Finally, the U.S. government has continuing lucrative contracts with the International Corporation of Assigned Names and Numbers (ICANN), the entity that controls the allocation and assignment of domain names, IP Addresses, AS numbers, and protocol port and parameter numbers. Government influence could be employed to encourage ICANN to include violations of pornography laws in the Uniform Domain-Name Dispute-Resolution Policy (UDRP) now used to enforce trademark laws internationally.

ICANN: Draft Proposed Changes to Registrar Accreditation Agreement
This announcement describes fifteen draft amendments to the Registrar Accreditation Agreement (RAA) for consideration and discussion by the ICANN community. Potential Danger Ahead for Registrants: dot-info Abusive Domain Use Policy by George Kirikos
ICANN has posted a request by Afilias for a new registry service in relation to "abusive" domains in dot-info. While in general the proposal is motivated by good intentions, the devil is in the details. While most folks (including myself) probably care very little about the .info TLD, my concern is that any bad implementation in .info might be copied or used as a precedent in other more important TLDs, in particular .com run by VeriSign.

Unforeseen Legal Consequences of Implementing Internationalized Top-Level Domains
ICANN is currently analyzing technical and policy implications regarding the introduction of Internationalized TLDs into the root. ICANN to Add Anti Front Running Charge?
... ICANN is considering a new $0.20 per-transaction fee for large numbers of domain registrations in order to curtail domain tasting abuse. Will ICANN take action against "worst" Chinese registrar?
Last month, ICANN was the target of a public complaint that it wasn't doing enough to fight spam and bogus websites. The complaint was made by anti-spam service Knujon (see disclosure at the bottom of this post), which suggested that most spam-related websites were funneled through 20 ICANN-approved registrars based in the United States and overseas. The company said that ICANN, despite being repeatedly notified that the registrars' WHOIS records were filled with false address and contact information for millions of spam sites, did not follow its own mandate to force WHOIS compliance among the worst offenders.

Holders of .ca domain names gain privacy
The Canadian Internet Registration Authority (CIRA), a non-profit corporation that handles .ca domain names, announced some big changes today. China Web Boom: .CN Now More Popular than .Net
China's top-level domain has now surpassed .net as the web's third most popular top-level and second most popular country-specific domain, according to a study by VeriSign says the Associated Press. VeriSign said that registrations of .cn domains had surged 23% in the first quarter of this year, and tripled year-over-year. China's domain boom is a sign of the country's growing importance on the web and rapidly expanding Internet user base.

SIDN, the .nl registry, today announced that, with effect from 14 July 2008, the 'Regulations on the Registration of .nl Domain Names' will be replaced by two sets of general terms and conditions: one for registrars, and the other for registrants. George Kirikos has always done an excellent job spotting potential dangers for the domain community. Now he has found a new request by Afilias for a registry service relating to the “abusive” use of .info domain names. DotInfo has been a popular top-level domain with spammers, because the .info annual registration fee has usually been lower than the renewal fee of other TLDs.

Facebook Tries to Blaze a Path in Russia
And Russian politicians have their eyes on expanding Russia’s role in the Internet. Russia’s new President, Dmitri A. Medvedev, appealed to the International Congress of Russian Press in Moscow last week for the creation of a Cyrillic Internet domain name for Russia. Mr. Medvedev, in fact, has shown himself to be pretty computer literate. In April, he even gave a speech at Russia’s Internet Forum where he revealed that he had been surfing Odnoklassniki, Russia’s answer to Classmates.com.

Nominet Domain name sales scam [news release]
A domain name sales scam has been brought to our attention. A company called Domain Name Registrar (UKDNR) are telephoning UK based .uk and .com domain name holders. They claim to be a Nominet member. Their high pressure sales technique centres around claims that someone is attempting to register .uk domain names relating to the victim's business. UKDNR then offer to register the .uk names on their behalf.

Call for Reporting Disputable .yu Domains
The Transition Commission of RNIDS invites Registrars and the Internet community to take a more active part in reporting disputable .yu domains. Fast reporting and solving problems regarding .yu register will ensure that there are no damaged parties on 10th September, when all unregistered .yu domains become available for registration. The sessions of the Transition Commission are held at least twice a week. The aim of the Commission and RNIDS is to enable pre-registration for the largest possible number of disputable .yu domains before the final deadline.

VeriSigns Titan-Projekt soll für mehr Sicherheit sorgen

Rund 100 sogenannte Anycast-Instanzen hatte VeriSign im Rahmen seines Projekts Titan bis zum Jahr 2010 angekündigt. Das Projekt liege voll im Zeitplan, sagte VeriSigns CTO Ken de Silva im Gespräch mit heise online. Nachdem die DNS-Infrastruktur in der ersten Phase vor allem um "zusätzliche Boxen" erweitert worden sei, werde man sich nun verstärkt um zusätzliche Sicherheit der DNS-Infrastruktur kümmern. Die wird auch ein Thema beim Pariser ICANN-Treffen in der kommenden Woche sein.

Offshore Porn is a Flimsy Excuse by Cheryl B. Preston
Abstract: Congress's efforts to protect children from online pornography have been stymied again. On remand from the Supreme Court, the district court in ACLU v. Gonzalez found the Child Online Protection Act (COPA) underinclusive, among other defects, because it was not applicable to a large amount of material that is unsuitable for children which originates overseas but is nevertheless available to children in the United States. (ACLU v. Gonzales, 478 F. Supp. 2d 775, 810 (E.D. Penn. 2007). The problem of offshore porn has been repeatedly raised by legislators and commentators, as well, as an excuse for not taking responsibility for finding a reasonable and constitutional solution in the United States. This paper argues, first, that lack of extraterritorial reach is not a legitimate ground for finding a congressional enactment unconstitutional. Second, Internet service providers (ISP) in the United States may easily employ technology that block IP
 Addresses from countries that fail to regulate sexually explicit content at the request, and only with respect to the accounts, of those customers who wish to avoid the risk. Third, an effective regulatory scheme enforced against all who serve sexually explicit material to minors from within the jurisdiction of the United States and which would curb a sufficiently large segment of the Internet pornography problem can be justified. Fourth, the opportunity to reach U.S. customers and do business in U.S. cyberspace is economically valuable. Many website owners would be willing to comply with U.S. law to be permitted to reach families and children. Moreover, the U.S. government can offer incentives for compliance.

Abstract: The legislative and political choices at the birth of the information technology society caused and will likely continue to cause significant ramifications in the course of digitizing human culture. This article considers both the positive and negative ways that the crash of the Communications Decency Act (the CDA), as well as Congress and the Supreme Court's understandings of the Internet at the time, may influence subsequent technological, legal, and social developments involving the World Wide Web. This article explores answers to these questions: What we can assume about Congress and the Supreme Court's Internet understanding in 1995-1997? What if the 104th Congress and the Supreme Court that dealt with the CDA had been more tech-savvy? Would Congress have written a better, tighter statute or none at all? What sorts of technological advancements might have been allowed to flourish, and what sorts would have stalled? Would the U.S.
 government have kept a tighter hold on the ability to enforce violations of law in the Domain Name System? Would the Court have framed its analysis differently, even if it ultimately ruled that the CDA was unconstitutional? How might the lives of members of the Net Generation played out differently?

Making Family-Friendly Internet a Reality: The Internet Community Ports Act by Cheryl B. Preston [Brigham Young University Law Review]
Abstract: The time has arrived to work together to find a reasonable balance among the values of the First Amendment, the appeal of an unfettered technological frontier, the right to be free of unwanted speech, and the right of parents to have the aid of the government in protecting children from age-inappropriate sexually explicit content online. One objective of this Article is to stimulate the discussion and the innovation necessary to arrive at some solution. In this Article, I provide an overview of one suggestion, the Internet Community Ports Act (ICPA). ICPA is devised to provide nation-wide support for the effective implementation of Internet zoning technology. ICPA allows parents to make meaningful choices concerning their children's access to sexually graphic material, while still allowing adults to publish and access any legal content online. ICPA relies on channeling content among the over 65,000 Internet ports rather than, as is the current
 practice, sending virtually all content together over just a handful of ports. ICPA does not prevent any willing adult from speaking or hearing any legal speech. Rather, it gives citizens the option of requesting from their Internet service provider only those ports on which material that is harmful for minors may not be posted.

Zoning the Internet: A New Approach to Protecting Children Online by Cheryl B. Preston [Brigham Young University Law Review]
Abstract: This Article considers how Internet architecture can be harnessed to create an online environment where government regulation of material harmful to minors can be effective but not unreasonably burdensome. It proposes a solution that engages technology in refocusing the point of regulation, thereby reducing the burden on speech and increasing the ability to achieve constitutionally recognized governmental objectives. This Article briefly examines failed congressional attempts to restrict children's access to sexually explicit content online, and then introduces the Internet Community Ports Concept, which relies on channeling technology to divide kinds of content among various Internet ports. After briefly outlining the technological workings of the Internet, this Article describes the Internet Community Ports Act (ICPA), which supports and enforces the zoning divisions. Together technology and legislation can create safe places for children and
 families on the Internet. The bulk of the Article discusses the constitutional implications of ICPA and how it will survive even strict scrutiny. Finally, it responds to a variety of other issues, such as market disincentives to separating content, the failed Dot Kids approach, the risk of chilled speech, stigma, and over-blocking, and the problems with filters.

Self Produced Child Pornography: The Appropriate Societal Response to Self Exploitation by Mary Leary [CUA Columbus School of Law Legal Studies Research Paper]
Abstract: One need only read the newspaper to see a rising dangerous phenomenon among juveniles: the creation and subsequent sharing via the Internet of sexually explicit photographs. This "self exploitation" is not only a tragic social problem, but a growing legal one as well. Judges, attorneys, and legislators, are forced to address this activity because, in addition to being self destructive, it is also a violation of state and federal child pornography laws. Juvenile self exploitation illustrates a clash of two lines of jurisprudence and public policy: the aggressive opposition to child pornography and the more lenient rehabilitative treatment of juvenile self destructive behavior. This article offers an in depth analysis of the appropriate societal and governmental response to this behavior and, specifically, whether juvenile prosecution should remain an option for the state. The article analyzes all the growing number of cases in this area; other
 legal models including criminal child pornography laws, child prostitution laws, and statutory rape laws; the doctrinal bases for governmental intervention in juveniles' lives; as well as numerous social science studies concerning child pornography's effects. Among those most closely examined are the social harms recognized by social science, the courts, and legislatures. The article concludes that, based upon the vast social harms caused by child pornography to children within and exposed to the images, the purpose of the juvenile justice system, and the need for a deterrent to this behavior, juvenile prosecution should remain an option for the state. While prosecution should not be mandatory, policy makers should create a policy and protocol for addressing this self destructive behavior. The article concludes with a proposed protocol offering guidance to policy makers as to when prosecution befits the activity and when it does not.
