Jurisdiction and the Internet after Gutnick and Yahoo!

This paper considers jurisdictional issues associated
with the Internet, with a focus on defamation as it
arises on the Internet. The leading Australian case of
Gutnick provides a key basis for analysis, and reveals
that the traditional rules of jurisdiction can, and
do, provide a sound basis for Internet regulation.

Freedom of Expression -v- The Multiple Publication
Rule
This paper proposes to consider just one small cog in
the information wheel, to illustrate how just one ill
considered decision in one jurisdiction can
reverberate throughout the whole of the principals
tentatively governing the net. That cog is the
Publication Rule- the theory behind what happens in
law when the clickeratti hit a press web site. As will
be demonstrated, this one cog has the potential to not
only grossly undermine that foundation of all
democratic society- the freedom of expression but also
to threaten the usefulness of the web as a valuable
media forum.

Regulating Spam in Hong Kong and Malaysia: Lessons

This article intends to look at the menace of spamming
and the shortcomings of the various legislations which
have recently been promulgated in Australia, the
United States and the United Kingdom in an attempt to
address the issue. Firstly, the article explains what
is spam and how it affects the Internet community and
the Internet as a whole. Secondly, it looks at the
varied responses of the Internet community and
possible causes of action that have arisen to deal
with spam. Thirdly, the article examines whether the
legislations recently enacted have addressed the
elements that represent the problem of spamming such
as the identification of the sender of a spam message
and the issue of bulk messaging. Bulk messaging is an
important element in the regulation of spam as it is
the volume of such e-messages sent that is the core of
the matter. Fourthly, it evaluates various measures
such as opt in/opt out mechanism adopted by Australia,
the United States and the United Kingdom and the
effectiveness of such measures in their attempt to
stop spam in its tracks. Fifthly, the article examines
the position in Hong Kong and Malaysia with respect to
the deficiencies in the common law and the existing
legislation in facing the challenge of 21st century
junk mail. Finally, the article proposes that only a
global solution to a global problem is an appropriate
and adequate measure in any attempt to regulate spam.

The Joint IDA-AGC Consultation Paper on the
Legislative Framework for the Control of E-Mail Spam -
A Commentary
In Part 2, the Consultation paper identifies the
problems caused by spam and more importantly the
reasons for the proliferation of spam and the
challenges which the authorities face in controlling
spam. Part 3 sets out the IDA?s proposed approach to
curbing spam: a multi-pronged approach combining the
following elements: technology, public education,
self-regulation, spam control legislation and
international co-operation, each of which is covered
in detail. It also identifies current legislation
which may have an effect on spam, such as the Computer
Misuse Act (Cap 50A) and the Consumer Protection (Fair
Trading) Act 2003, extracts of which are included in
Annex B. Part 4 briefly sums up conclusions drawn from
a survey conducted by the AGC of legislative and
regulatory frameworks relating to Australia, the UK,
the USA, Japan and South Korea. The results of the
survey are set out in a comparative table in Annex B.

Someone to Watch Over Me: Social Policies for the
Internet
Abstract: This Article presents a comprehensive
inquiry into the social policies the FCC is imposing
on the internet. It begins by describing the mindset
of telephony companies, and why telephonists believe
that someone must be in charge of any network, and
continues by examining the mindset of internet
exceptionalists, and why their beliefs in the
unfettered future of the internet may prove remarkably
naive. Next, the Article explains how the FCC has
construed its implementing statute to give it
authority to make rules for internet applications, and
examines three social policies that are being
transferred wholesale by the FCC into the internet
context. Finally, the Article offers a normative
proposal for online social policies. This section
argues that Congress should take the nature of the
internet into account when adjusting the FCC's
statutory powers. The section justifies this proposal
on several grounds. First, although the social
concerns addressed by the FCC's actions (emergency
service, assistance to law enforcement, funding of
universal service) are substantial, there are better,
more technologically sophisticated ways to implement
these same policies online, and the path the FCC is
taking is likely to be destructive of nascent online
services and products. Second, there are other social
policies that are equally important for the future of
U.S. citizens, including open access and consumer
education. Third, the proposed approach is consistent
with the direction that Congress has taken thus far
with respect to the internet, which has resulted in
enormous innovation, creative collaboration, economic
growth, and social development. The world is watching
what the U.S. does, and Congress should act carefully
as it takes on the regulation of the internet.

Social Interactions and the 'Digital Divide':
Explaining Regional Variations in Internet Use
Abstract: The presence of extraordinary geographical
variation in Internet use in the U.S. is widely
acknowledged. Prior research suggests that individual,
household, and regional differences are responsible
for this disparity. We argue for an alternative
explanation: that individual choice is subject to
social influence, and that such "peer effects" are the
cause of the excess variation. We test this assertion
with empirical analysis of a matched data set compiled
from two sources. The first is a dataset collected by
the Pew Charitable Trust in June 2003 comprising of a
nationwide random sample where a questionnaire is used
to collect details on Internet use as well as personal
characteristics such as age, income, and education of
respondents. The geographic location of individuals is
identified by the FIP code that represents the county
where the respondent resides. From the 2000 Census we
then extract a number of regional characteristics for
this location (such as median household income, median
age, etc.). We begin with a linear probability model
of choice, and then use an instrumental variables (IV)
approach to address simultaneity and other problems.
In addition, we present the results from a logistic
regression model. Our analysis of the data provides
strong evidence of peer effects, suggesting that
individual Internet use is influenced by local
patterns of usage. In fact, regional differences (such
as between urban and rural areas) as well as
individual differences appear to matter less when peer
group choices are taken into account. Our IV results
suggest that the correlation between individual and
group choice is not a consequence of unobserved
individual or regional characteristics.

Internet Stings Directed at Pedophiles: A Study in
Philosophy and Law
Abstract: This paper considers a jurisprudential issue
that has heretofore not received much attention: Do
Internet Stings Directed at Pedophiles Create
Offenders or Capture Offenders? to paraphrase my 2002
article in Sexuality and Culture which opened this
subject. Section II presents the jurisprudential
argument, while Section I gives a framework for
classifying work in jurisprudence as (1) an
application of ethics and allied fields to legal
matters - the traditional definition, (2) a
philosophical examination of a legal question, the
argument does not depend on ethical premises but
rather given data only appeals to (already) shared
ethical premises, and (3) a kind of examination that
takes existing legal frameworks as a given and then
makes an ethical argument within those frameworks,
with the aim of achieving logical coherence of the
whole.

Regulating 'Spyware': The Limitations of State
'Laboratories' and the Case for Federal Preemption of
State Unfair Competition Laws
Abstract: Drawing on Justice Brandeis's oft-cited
observation that states can serve as "laboratories" of
policy experimentation, this Article develops a
framework for assessing the allocation of governance
authority for regulating Internet activities. In
particular, it focuses on whether states should be
free to experiment with regulatory approaches or
whether the federal government should have principal,
if not exclusive (preemptive), regulatory authority
over Internet-related activities. Using recent efforts
to regulate spyware and adware as a case study, the
analysis shows that the lack of harmonization of, and
uncertainty surrounding, state unfair competition law
produces costly, confusing, multi-district litigation
and pushes enterprises to adhere to the limits of the
most restrictive state. Such a governance regime
unduly hinders innovation in Internet business models.
On this basis, the Article favors a uniform federal
regulatory system and pre-emption of state statutes
and unfair competition common law as applied to
spyware and adware. The final section of the Article
extrapolates from this study of spyware and adware
regulation to the larger context of Internet
governance.

have developed a code of conduct to protect young
people. As Vodafone announced, this code of conduct

the mobile use of chat rooms and downloads of movies

be hired. This campaign stems from a youth protection
agreement that the companies involved signed in the
