Surfing While Muslim: Privacy, Freedom of Expression &
the Unintended Consequences of Cybercrime Legislation

Abstract: The Canadian government’s Lawful Access
discussion paper fails to provide empirical – or
anything beyond anecdotal – evidence that the
legislative amendments proposed are actually needed.
Evidence derived from U.S. law enforcement agencies
suggests that technological and administrative
impediments – more than legal ones – are the cause of
most difficulties experienced in cybercrime
investigations and prosecutions, specifically:
insufficient basic record keeping by
telecommunications and Internet service providers;
inability to effect data preservation
extraterritorially; inability to circumvent
encryption; and, a lack of common data-sharing
protocols.

Privacy vs. Piracy by Sonia K. Katyal [International

Abstract: A few years ago, it was fanciful to imagine
a world where intellectual property owners -- such as
record companies, software owners, and publishers --
were capable of invading the most sacred areas of the
home in order to track, deter, and control uses of
their products. Yet, today, strategies of copyright
enforcement have rapidly multiplied, each strategy
more invasive than the last. This new surveillance
exposes the paradoxical nature of the Internet: It
offers both the consumer and creator a seemingly
endless capacity for human expression -- a virtual
marketplace of ideas -- alongside an insurmountable
array of capacities for panoptic surveillance. As a
result, the Internet both enables and silences speech,
often simultaneously. ... The goals of this Article
are threefold: first, to trace the origins of piracy
surveillance through recent jurisprudence involving
copyright; second, to provide an analysis of the
tradeoffs between public and private enforcement of
copyright; and third, to suggest some ways in which
the law can restore a balance between the protection
of copyright and civil liberties in cyberspace.

Characteristics of a Fictitious Child Victim: Turning
a Sex Offender’s Dreams Into His Worst Nightmare by

Abstract: There have been more criminal offenses
involving the possession, manufacture and distribution
of child pornography in the past decade than at any
time in history. Sex offenders have exploited the ease
of using home computers, peripheral devices and the
Internet; computers and the Internet are now
recognized means by which sex offenders can seek out
and lure child victims. The Internet has afforded sex
offenders contact with child victims whom they
otherwise would not be able to access. Law enforcement
has responded to the public outcry for greater law
enforcement presence and intervention on the Internet,
recognizing the threat this new technology poses to
children. Both the United States Congress and many
individual states have responded by enacting new
statutes and modifying old laws to deal with this
relatively new and growing danger. Law enforcement has
in turn increased its undercover presence on the
Internet, while also developing innovative procedures
and techniques to detect and successfully prosecute
online offenders. The goals of this article are
twofold: first, to present a depiction of the “perfect
victim” using research and the author’s own
experience; and, second, to suggest methods by which
law enforcement personnel can more effectively
apprehend child sex offenders on the Web.

Sharing in the Groove: Ninth Circuit Allows
Peer-to-Peer Networks To Continue File-Sharing MGM
Studios, Inc. v. Grokster, Ltd., 380 F.3d 1154 (9th

Over the past several years, as the Internet has grown
exponentially, the exchange of information and ideas
has become both faster and more efficient. One
particular type of information users exchange over the
Internet is digital music, and often the exchange
utilizes a peer-to-peer network. Peer-to-peer networks
allow individual users to connect directly to several
other users and download music, movies, and other
files from them. Napster was the most popular
peer-to-peer network initially, but many other,
similar networks have followed in Napster’s footsteps.
Many of the users sharing music and movies violated
copyright laws, however, so these peer-to-peer
applications have become targets for copyright owners
seeking to reestablish their exclusive rights to their
material. In August 2004, the Ninth Circuit Court of
Appeals decided MGM Studios, Inc. v. Grokster, Ltd.,
and determined that peer-to-peer networks are not
liable for their users’ copyright infringement as long
as there are substantial legitimate uses of the
software. The Ninth Circuit held that although the
users of the peer-to-peer networks were committing
direct copyright infringement, the creators of the
software itself were not contributorily or vicariously
liable for the copyright infringement.

CAN-SPAM: A First Step to No-Spam by Grant C. Yang
On December 16, 2003, President George W. Bush signed
the first federal law regulating spam.[2] The law,
titled the “Controlling the Assault of Non-Solicited
Pornography and Marketing Act of 2003” (CAN-SPAM), has
garnered much criticism from scholars and the Internet
community. Its effectiveness has even been
questioned[3] by the Federal Trade Commission (FTC),
the regulatory agency in charge of administering the
law.[4] On the other hand, the law, effective as of
January 1, 2004,[5] has the support of both Internet
Service Providers (ISP)[6] and the advertising
industry.[7] It has been regarded by many as a
necessary step in order to combat the growing amount
of spam. Critics contend that it is less effective
than many of the current state laws. However, they
must realize that CAN-SPAM is not meant to be a
cure-all. Instead, it is a necessary first step toward
uniformity in spam laws, as ultimately, the most
viable solution will require an international
approach.
