THE DORMANT COMMERCE CLAUSE AND STATE REGULATION OF
THE INTERNET: ARE LAWS PROTECTING MINORS FROM SEXUAL
PREDATORS CONSTITUTIONALLY DIFFERENT THAN THOSE
PROTECTING MINORS FROM SEXUALLY EXPLICIT MATERIALS?

Several states have enacted statutes to protect minors
from harmful or obscene materials disseminated over
the Internet, as well as from pedophiles seeking to
use the Internet to lure them into sexual conduct.
State and federal courts have diverged in their
analysis of the Dormant Commerce Clause's impact on
state regulation in these areas. While state courts
have held that the Dormant Commerce Clause does not
invalidate state luring statutes, federal courts have
been consistent in finding state dissemination
statutes unconstitutional. This iBrief summarizes
recent state and federal jurisprudence in this area
and concludes that state courts have not been
successful in distinguishing state luring statutes
from federal case law on state dissemination statutes.
Therefore, state courts have prematurely aborted the
Dormant Commerce Clause examination.

CANNING SPAM: CONSUMER PROTECTION OR A LID ON FREE
SPEECH? 2004 Duke L. & Tech. Rev. 0016
The United States Congress recently passed the first
federal legislation to curb the influx of spam.
However, the Controlling the Assault of Non-Solicited
Pornography and Marketing Act (“CAN-SPAM Act”) left
some measures to be enacted by the Federal Trade
Commission (“FTC”), and some consumers are calling for
the Act to have a broader reach and for the creation
of a Do-Not-E-Mail registry. Conversely, the FTC
decided to delay the creation of a registry and opted
to assist in the development of a new technological
authentication system. This iBrief looks at the
current state of spam and explains that it is too
early to tell whether the effects of the CAN-SPAM Act
warrant new anti-spam measures. In addition, it points
out that it is questionable whether the FTC's current
authentication approach will be effective, and, thus,
considers the possible First Amendment challenges to a
Do-Not-Call registry as well as other possible
anti-spam solutions. In the end, this iBrief
postulates that the most effective option might be for
the FTC to implement both a Do-Not-Email registry and
an authentication system.

PRIVACY, FREE SPEECH & THE GARDEN GROVE CYBER CAFÉ
EXPERIMENT 2004 Duke L. & Tech. Rev. 0012
In response to gang violence at local "cyber cafés,"
the City Council of Garden Grove, California, passed
an ordinance requiring cyber cafés to install video
surveillance systems. The constitutionality of the
provision was subsequently challenged, and a
California Court of Appeal determined that the video
surveillance requirement did not violate free speech
or privacy protections under either the federal or
California Constitutions. This decision was
immediately challenged, by commentators and a
dissenting judge, as opening the door to
Orwellian-type, government intrusions into
individuals' personal lives. This iBrief analyzes the
appellate court's decision and concludes that not only
did the majority reach the correct conclusion, but
that there is no merit to the dissent's Orwellian
fears.

P2P File-Sharing: What the Supreme Court Has an

When the United States Supreme Court hears
Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd.
(04-480) on March 29th, it has an opportunity to
consider for the first time, the rights,
responsibilities and liabilities of p2p network
creators and their users, the content industry, and
ISPs.  Over 25 of the world’s largest entertainment
conglomerates joined together in petitioning the
Supreme Court for a grant of certiorari.  Petitioners
characterize this case as "one of the most important
copyright cases ever to reach this Court.  Resolution
of the question presented here will largely determine
the value, indeed the very significance, of copyright
in the digital era."  Respondents agree that the
stakes are considerable, observing that this "case
raises a question of critical importance at the border
between copyright and innovation: when should
distributors of p2p software — a multi-purpose tool —
be held liable for infringements that may be committed
by end-users of the tool?"

Piercing the peer–to–peer myths: An examination of the
Canadian experience by Michael Geist
Abstract: This article examines CRIA’s claims by
conducting an analysis of industry figures. It
concludes that loss claims have been greatly
exaggerated and challenges the contention that recent
sales declines are primarily attributable to
file–sharing activities. Moreover, the article
assesses the financial impact of declining sales on
Canadian artists, concluding that revenue collected
through a private copying levy system already
adequately compensates Canadian artists for the
private copying that occurs on peer–to–peer networks.

Abstract: Remote Internet voting has been proposed as
a solution to low voter turnout. It is tempting to see
the use of Internet technology by a large segment of
the population as a quick fix for making the voting
process more accessible to a larger number of people.
This argument, however, demonstrates a disconnect with
the reality of Internet use; that is, that it happens
in a place. Internet use is not an ethereal,
boundary–less activity, it is situated in a
spatial/geographic context. Reviewing this geographic
context using Geographic Information System technology
can reveal the serious limitations of a "point and
click" solution to improving political participation.

Abstract: This paper reports a small number of
interviews with young people in Athens about their use
of Internet chatrooms as a means of meeting people. In
the last few years there has been a growing public
concern about the dangers of socialising with
strangers in chatrooms, but what do the users
themselves think about the risks involved, and what
strategies have they adopted to manage these risks?
Some of the practices adopted by these young people
are surprising and counter to the conventional advice
given by official authorities.

The Battle for Mindshare: The Emerging Consensus that
the First Amendment Protects Corporate Criticism and
Parody on the Internet by Hannibal Travis (Va. J.L. &
Tech. 3 (2005))
This article describes the development of trademark
liability for corporate criticism or parody on the
Internet and the emerging judicial consensus that
imposing liability on this form of political speech
violates the First Amendment rights of Internet users.
The article begins by analyzing the expansion of
trademark rights from a method of protecting merchants
against counterfeiting into a broad-ranging tort
against any invasion of consumers’ good feelings
towards a business or its products. Courts and
Congress made this expansion possible by eroding the
requirement of commercial competition as a
prerequisite to trademark liability and by crafting
sometimes overbroad rules against creating “initial
interest confusion,” establishing negative
associations with a trademark, or “cybersquatting” on
a domain name similar to a mark. Fortunately, the
federal appellate courts are making it increasingly
clear that the First Amendment shields Internet speech
devoted to criticizing or making fun of corporations
from censorship under trademark law. The author argues
that this emerging consensus is consistent with the
principal normative justifications for trademark
rights as a means of preserving valuable property
interests and promoting economic efficiency. Finally,
he contends that trademark rights should be restricted
to policing commercial competition, rather than
non-commercial Internet speech. This limitation is
essential if consumers are to preserve their autonomy
in light of the pervasive influence of advertising and
their ability to participate fully in a democratic
society in light of the considerable power of the
business world.
