How Rights Change: Freedom of Speech in the Digital
Era by JACK M BALKIN [2004]
Abstract: Technological change produces new forms of
social conflict. The digital revolution is no
exception: lowering the costs of distribution and
content creation inevitably creates conflicts between
ordinary individuals and the information industries.
Freedom of speech is a key site for these struggles,
as media companies repeatedly attempt to expand
intellectual property rights at the expense of
individual free expression, while simultaneously
invoking freedom of expression to oppose
telecommunications regulation. This stunted vision of
free speech undermines the creative and participatory
possibilities of the digital age; it treats ordinary
individuals as passive consumers rather than active
producers of their cultural world. We must promote a
democratic culture that celebrates interactivity and
widespread cultural participation. Earlier free speech
theories concerned with democratic deliberation were
adapted to the twentieth century world of broadcast
media, in which only a relatively few people
controlled access to mass communication. Free speech
theory must now be dedicated to promoting each
individual's ability to participate in the growth and
development of culture.

Time passes. Twenty years ago in the OECD work was
beginning towards guidelines on the protection of
privacy in the context of transborder data flows. Ten
years ago work towards the later OECD guidelines on
security of information systems was commenced. I
chaired the two expert groups which prepared those
successive principles. That work opened my eyes to the
enormous implications of modern technology for the law
and human rights in every society. And to the capacity
of international institutions to help municipal law
makers respond to global problems. The work of the
OECD on the social and legal issues presented by
informatics illustrates the way in which the
international community is slowly but inexorably
constructing a mutually compatible legal order on the
foundation of “respect for human rights and
fundamental freedoms”.

ONLINE DEFAMATION: BRINGING THE COMMUNICATIONS DECENCY

According to the Communications Decency Act of 1996, a
provider of an interactive computer service cannot be
held liable for publishing a defamatory statement made
by another party. In addition, the service provider
cannot be held liable for refusing to remove the
statement from its service. This article postulates
that such immunity from producer and distributor
liability is a suspect public policy, and argues that
the statute should be amended to include a broad
definition of “development” and a “take-down and
put-back” provision.

CANNING SPAM: CONSUMER PROTECTION OR A LID ON FREE

The United States Congress recently passed the first
federal legislation to curb the influx of spam.
However, the Controlling the Assault of Non-Solicited
Pornography and Marketing Act (“CAN-SPAM Act”) left
some measures to be enacted by the Federal Trade
Commission (“FTC”), and some consumers are calling for
the Act to have a broader reach and for the creation
of a Do-Not-E-Mail registry. Conversely, the FTC
decided to delay the creation of a registry and opted
to assist in the development of a new technological
authentication system. This iBrief looks at the
current state of spam and explains that it is too
early to tell whether the effects of the CAN-SPAM Act
warrant new anti-spam measures. In addition, it points
out that it is questionable whether the FTC's current
authentication approach will be effective, and, thus,
considers the possible First Amendment challenges to a
Do-Not-Call registry as well as other possible
anti-spam solutions. In the end, this iBrief
postulates that the most effective option might be for
the FTC to implement both a Do-Not-Email registry and
an authentication system.

Report: Online Pedophilia up 300 Percent
Security vendor Panda Software Thursday announced a
300 percent increase in calls reporting online child
pornography over the last three years. Protogeles, a
European NGO formed to track and remove child

a part) just released a study documenting Internet
filtering in Bahrain. The OpenNet Initiative’s (ONI)
testing of more than 6,000 targeted sites revealed
only eight sites blocked from those seeking access
from within Bahrain. This modest filtering regime is
supported by both a legal context and a technical
infrastructure. The legal context includes extensive
potential controls of media, telecommunications, and
the Internet, while the technical infrastructure
includes a single primary Internet Service Provider
(ISP) and a state-mandated Internet exchange point
(IXP); the combination of both the legal context and
the technical infrastructure makes filtering
relatively easy to implement.

The 1997 Telecommunications Privacy Directive provided
that EU Member States had the possibility, but not the
obligation, to require telecom operators to retain
communication data arising out of the use of the
telecommunications system for law enforcement
purposes. That Directive was replaced by the 2002
Electronic Communications Directive in order to adapt
the EU legal regime to technical developments such as
the growth of the Internet. The new Directive extended
the scope of the 1997 Directive by explicitly allowing
EU countries to compel telecom and Internet service
providers (ISPs) to record and store traffic data
under certain circumstances. National laws must,
however, (a) ensure that the data are only retained
for a limited period of time; (b) aim to achieve
specific, enumerated "public order" purposes; (c) be
necessary, appropriate, and proportionate within a
democratic society for achieving these purposes; and
(d) be consistent with the European Convention on
Human Rights. The Directive fails to regulate the time
period for which the data must be retained.

FTC Clarifies what is Spam under the Federal CANSPAM
Act (reg req'd)
If you send e-mail messages to customers and
prospective customers, you should take note of the new
Federal Trade Commission guidelines implementing the
federal CAN-SPAM law which became effective on January
1, 2004. These guidelines attempt to clarify what is
commercial e-mail, and therefore subject to the Act’s
requirements, by defining when the "primary purpose"
of an email is commercial. The regulations took effect
