Content Regulation in Malaysia:Unleashing Missiles on

Abstract: The open and democratic nature of the
internet facilitates all kinds of abuses. Obscenity,
hatred speech, defamatory messages, indecent content
and other type of harmful content flourish in the
Internet. For this reason, many countries are now
regulating speech on the Internet, just like what they
have traditionally done for all other types of mass
media. To claim that the Internet must be left free
from the shackles of law and regulation would not just
create a lawless wild-wild-west but also would channel
all forms of illegal conduct and speech to migrate to
the ‘unregulated’ Internet.

Service Provider Licensing System in the Malaysian

Abstract: In 1998 the Malaysian government enacted the
Communications and Multimedia Act 1998 (Act 588) (CMA)
to cater for the convergence era of
telecommunications, broadcasting and information
technology. This CMA changed the definition of these
three previously distinct industries into the
communications and multimedia industry. One of the
reasons behind this was the contention on the part of
the government that to differentiate these three
industries would do more harm than good due to the
fact that technological advances no longer make it
viable to draw the lines differentiating them. One of
the most important parts of the CMA is the licencing
system it introduces.[1] This paper is divided into
two parts which will discuss the transitional
provisions for existing licence holders and the new
licencing system introduced.
