Research article: Defamation on the Internet: Joseph
Gutnick v Dow Jones by Anna Beyer
Abstract: This paper investigates a defamation dispute
involving an Australian businessman, Joseph Gutnick,
and an American publisher specialising in economic
reports and analyses, Dow Jones and Company. The
dispute has provided Australian courts with a major
opportunity to see how the rules of private
international law can be applied in the context of the
Internet. The paper considers the possible impact on
online publishing of a decision allowing Gutnick to
sue Dow in his home state of Victoria, Australia.
