Internet Filtering & the Law
What are the legal implications of limiting access to
Internet content? In this paper, the OpenNet
Initiative -- a partnership of the Citizen Lab, the
University of Cambridge, and the Berkman Center --
finds that governments offer a range of justifications
for blocking content, from safeguarding national
security to protecting community standards. Though
filtering has tremendous effects on civil liberties,
governmental policymaking, and Internet governance,
there are few mechanisms for examining and reforming
Internet censorship. The paper emphasizes the need for
transparency, accountability, and inclusiveness to
maintain a reliable, efficient, and global medium for

UN ICT Task Force Series 5 - Internet Governance: A
Grand Collaboration
Realizing the WSIS vision of constructing Internet
governance arrangements that are multilateral,
transparent and democratic with the full involvement
of all stakeholders is a noble challenge. Meeting it
will require goodwill among all parties, as well as
good information on which to base decisions. The
papers contributed to the United Nations Information
and Communication Technologies Task Force (ICT TF)
Global Forum on Internet Governance contain a lot of
useful information on how many different organizations
are already governing the Internet and its effects on
society. At the same time the papers suggest that a
number of important issues are not being addressed
effectively, and that in some areas there is an urgent
need to put in place new arrangements to counter real
and present threats to the stability and utility of
the Internet. These contributions helped participants
in the Forum begin the process of building a global
consensus on Internet governance – a process that
hopefully will continue beyond the second phase of the
WSIS. As a result of these contributions, the vision
of a “grand collaboration” on Internet governance is a
step closer to reality.

Reducing Digital Copyright Infringement Without

In this article, we argue that unrestricted liability
for anyone who is in any way involved with copyright
infringement is a bad idea. Indirect liability is a
continuum, in which acts most closely related to
infringement and with the fewest affirmative benefits
are the easiest to condemn. Going after makers of
technology for the uses to which their technologies
may be put threatens to stifle innovation. The
fundamental difficulty is that while courts can make
decisions about direct infringement on a case-by-case
basis, lawsuits based on indirect liability
necessarily sweep together both socially beneficial
and socially harmful uses of a program or service,
either permitting both uses or condemning both.

Children at Risk: Legal and Societal Perceptions of
the Potential Threat that the Possession of Child
Pornography Poses to Society by SUZANNE OST
This article examines legal and social discourses
surrounding the phenomenon of child pornography,
considering the legal responses to child pornography
(particularly when an individual is found to be in
possession of such material), and the way in which
such material, the child, and the possessor of child
pornography are socially constructed. The article
raises the question of whether there has been a moral
panic regarding child pornography and the possession
of such material, but also considers whether there are
real reasons to consider that the possession of child
pornography should remain illegal. Research studies
which aim to establish the existence of a causal link
between possessing child pornography and the act of
committing child sexual abuse are examined, as is the
argument that criminalizing the possession of child
pornography reduces the market for such material.
Finally, there is an analysis of the possible impact
of social constructions of the child as innocent.

Internet Filtering in China by JONATHAN ZITTRAIN and
BENJAMIN G. EDELMAN
Abstract: The authors are collecting data on the
methods, scope, and depth of selective barriers to
Internet access through Chinese networks. Tests from
May 2002 through November 2002 indicate at least four
distinct and independently operable methods of
Internet filtering, with a documentable leap in
filtering sophistication beginning in September 2002.
The authors document thousands of sites rendered
inaccessible using the most common and longstanding
filtering practice. These sites were found through
connections to the Internet by telephone dial-up link
and through proxy servers in China. Once so connected,
the authors attempted to access approximately two
hundred thousand web sites. The authors tracked 19,032
web sites that were inaccessible from China on
multiple occasions while remaining accessible from the
United States. Such sites contained information about
news, politics, health, commerce, and entertainment.
The authors conclude (1) that the Chinese government
maintains an active interest in preventing users from
viewing certain web content, both sexually explicit
and non-sexually explicit; (2) that it has managed to
configure overlapping nationwide systems to
effectively - if at times irregularly - block such
content from users who do not regularly seek to
circumvent such blocking; and (3) that such blocking
systems are becoming more refined even as they are
likely more labor- and technology-intensive to
maintain than cruder predecessors.

States and Internet Enforcement by JOEL REIDENBERG
Abstract: This essay addresses the enforcement of
decisions through Internet instruments. Traditionally,
a state's enforcement power was bounded by territorial
limits. However, for the online environment, the lack
of local assets and the assistance of foreign courts
no longer constrain state enforcement powers. States
can enforce their decisions and policies through
Internet instruments. Online mechanisms are available
and can be developed for such pursuits. The starting
point is a brief justification of Internet enforcement
as the obligation of democratic states. Next, the
essay describes the movement to re-engineer the
Internet infrastructure by public and private actions
and argues that the re-engineering facilitates state
enforcement of legal and policy decisions. The essay
maintains that states will increasingly try to use
network intermediaries such as payment systems and
Internet service providers as enforcement instruments.
Finally and most importantly, the essay focuses on
ways that states may harness the power of
technological instruments such as worms, filters and
packet interceptors to enforce decisions and sanction
malfeasance.

FCC Authority to Regulate the Internet: Creating It
and Limiting It by JAMES B. SPETA
Abstract: This short paper discusses the FCC's
authority, under its so-called ancillary jurisdiction
(under Title I of the Communications Act), to address
competition problems that may arise in Internet
markets. It is argued that the FCC likely does not
have jurisdiction to address most Internet regulatory
issues, because whatever expansive readings such
ancillary jurisdiction has received in the past are no
longer tenable. The paper proposes, instead, a new,
limited statutory interconnection rule, which the FCC
could enforce in limited ways in Internet markets. The
paper also argues that, even if the FCC does have
authority to develop its own common law of Internet
regulation, a limited grant of statutory authority is
a superior regulatory construct. The paper also argues
that FCC administration of this proposed statute is
superior to remitting all Internet interconnection
problems to the common law processes of antitrust.

definitions do not agree. Some talk about
applications. Some talk about packets. And others are
simply too vague to be of value. And yet, not
comprehending the object of the policy, the lawyers go
merrily forward constructing on faulty foundations
new, imaginative, and perhaps misdirected policy and
law. Is it possible to formulate a good definition of
The Internet? Is The Internet the technical specs that
currently make up The Internet? Is The Internet based
on the experience of The Internet by the user? Can a
definition of The Internet reflect its robust and
flexible nature, in all of its diversity, as it exists
today and what it might become tomorrow? Is there
something wrong with this simple question about the
definition of The Internet that makes it so hard to

fun of previous legal definitions of The Internet;
attempt to provide a foundational exploration of what

Illegal Internet Networks in the Developing World by

Abstract: Enabled by falling costs associated with
constructing international voice and data networks,
and motivated by high fees charged by incumbents for
international telecom services, illegal Internet
network operators are proliferating in many developing
countries. Unlicensed international data networks are
commonly used by competitive local Internet Service
Providers (ISPs) who do not have the means to obtain
an international gateway license, and by Internet
Telephony Service Providers (ITSPs) that deliver
international calling services utilizing
Voice-over-Internet Protocol (VoIP) technology.
Incumbent telecom operators and regulatory authorities
in countries where unlicensed international networks
are prevalent claim that these networks deprive local
governments of badly needed revenue. However,
unlicensed international network operators also offer
a new, market-oriented model for bringing the
developing world online. This model is not without
political, economic, and legal risks. For example,
illegal Internet networks pose a potential global
security hazard as data transmitted over these
networks can be difficult to monitor by intelligence
agencies. Voice calls made using Internet telephony
technology over these networks can be doubly difficult
to track using existing legal intercept technology. As
evinced by a recent WTO ruling, growing recognition of
illegal telecom networks may lead the international
community to push governments of developing countries
to adopt more liberal pricing and licensing policies
and to pressure governments of developed countries to
crack down on companies in their jurisdiction that
partner with illegal network operators.

The Internet is so important to all of us that we must
act collectively to control pernicious forms of
electronic wrongdoing online. But we should keep the
fundamental architecture and values of the Internet in
mind as we do so. An increasing ability to verify that
a message comes from someone from whom we want to hear
can enhance our individual abilities to construct an
Internet that reflects and tolerates diverse values.
We should embrace that change. The risks involved in
an Internet that makes peers accountable to one
another are much lower than the risks of empowering
any centralized global authority to make connection
