us: Anti-Porn Burden Bounced Back By SCOTUS (From The
Filter - A publication of the Berkman Center for
Internet & Society at Harvard Law School
http://cyber.law.harvard.edu
The Supreme Court of the United States recently ruled
against a federal law that would have restricted
access to internet pornography websites, but a number
of questions remain about the constitutionality of the
Child Online Protection Act (COPA), a law passed in
1998 to limit access to websites deemed "harmful to
minors." Civil liberties groups like the ACLU have
opposed the statute for its restrictions on First
Amendment freedoms, but the court did not strike down
the law entirely. Instead, the 5-4 decision concludes
that the law can stand only if it provides the "least
restrictive alternative" for protecting minors. Lower
courts will have to continue to consider whether
private filtering clients can accomplish the desired
end without unnecessary restrictions on free speech
and expression. Six years of legal action in the
highest courts, beginning with the now-defunct
Communications Decency Act, have failed to reach a
completeconclusion.

10 Reasons Why Involving Government in Spam Control is
a Bad Idea
1. Many jurisdictions already have laws which cover
abuse of computer systems and networks -- and spam is
of course abuse. These laws are only sporadically
enforced, however, usually when a sufficiently
visible/powerful entity is the aggrieved party. Adding
more laws (a) is redundant and (b) does not increase
enforcement. 2. Laws are only enforced as law
enforcement has resources available. Spam/abuse is not
a high priority unless a sufficiently visible/powerful
entity makes it so, and those cases are rare.
