The FTC has told the Subcommittee on Commerce, Trade, and
Consumer Protection of the House Committee on Energy and
Commerce that “spyware appears to be a new and rapidly
growing practice that poses a risk of serious harm to
consumers.” In testimony before this Subcommittee, the
Commission stated that the FTC is studying the issues
surrounding spyware “. . . so that government responses to
spyware will be focused and effective.”

The US Federal Trade Commission has filed a legal action
against Global Web Promotions, a spam enterprise that
operates out of Australia and New Zealand, as part of its
first criminal prosecution under the new US federal
anti-spam law.

The FTC has cracked down on two spam operations that have
clogged the Internet with millions of deceptive messages
and violated federal laws. A complaint targeting
Detroit-based Phoenix Avatar was developed in a joint
investigation with the U.S. Attorney’s Office in Detroit
and the U.S. Postal Inspection Service. At the request of
the FTC, a U.S. District Court judge has barred the illegal
spamming and frozen the defendants’ assets. Federal
criminal authorities yesterday executed a criminal search
warrant and are in the process of arresting four principals
in that case. In the second case, the FTC filed a legal
action against Global Web Promotions, a spam enterprise
that operates out of Australia and New Zealand.

nz: Xtra may block dodgy senders
New Zealand's largest Internet service provider, Telecom's
Xtra, may refuse e-mail from some IP addresses in order to
curb a surge in e-mail volumes.

uk: MPs urged to reform cybercrime laws
UK computer crime law needs a root and branch reform to
bring it into the Internet age. MPs holding a public
inquiry to see if Britain’s key computer crime law - the
Computer Misuse Act 1990 - were told the law had served us
well but now needed to be updated. Industry representatives
appearing before an All Party Parliamentary Internet Group

significant amendments to existing laws or fresh

Norway: High Court Finds Music Website Links Do Not
Constitute Performance
On January 22 2003 a Norwegian district court found that a
man operating a website with the address www.napster.no had
committed copyright infringement by putting direct links on
this site to music files illegally placed on other
websites. The linking was deemed to be a 'performance' of
musical works pursuant to Section 2 of the Norwegian
Copyright Act as it made works available to the public,
which is the exclusive right of the copyright holder.
