A federal court has dismissed a suit launched against the Department
of Commerce over the ICANN UDRP. The plaintiff filed the action after
losing a UDRP action over the bancochile.com domain. The court ruled
that the plaintiff lacked standing to sue the DOC, finding that he
could not show a connection between the department and the

Court Declines Jurisdiction Over "Active Site" (from BNA Internet Law

BNA's Electronic Commerce Law Daily reports on a recent Maryland
federal court case in which the court declined to assert jurisdiction
over a California-based site despite evidence of 46 transactions with
state residents. The court ruled that the transactions were not
sufficient evidence of a continuous contact for the assertion of
general jurisdiction. The court added that while the site was
properly characterized as "active" that was of little significance.

Court Declines Jurisdiction Over News Portal (from BNA Internet Law
News)
A federal court in Virginia has refused to assert jurisdiction in a
trademark infringement suit between competing news link sites. The
Newspaper Association of America, which runs newspaperlinks.com,
launched the action against a Florida resident who runs a similar
site at newspaperlink.com. The court transferred the case to Florida,
however, after finding that though the linked-to sites were active,
the actual linking site was merely passively providing information.
