MODIFICATION OF DOMAIN NAME RULES
The Research Support Foundation of the State of São Paulo (FAPESP),
the entity responsible for the registration of domain names in
Brazil, has issued new rules for domain names. According to the
rules, the limit of 10 domain names that a company could register
ceased to exist as of April 4, 2002. Therefore, a company may now
register, under the same taxpayer number, an unlimited number of
domain names. This rule, however, has not modified the restriction on
registration of the same domain name under different domain name
levels for example 'xxx.com.br' and 'xxx.ind.br'.

Extended Jurisdiction For .no TLD Name Appeal Body
According to a press release from the Ministry of Transport, a
working group within the Ministry has issued a report regarding the
administration of the top level domain '.no'. The working group
proposes to extend the jurisdiction of the current appeal organ
(NORIDS klageorgan) to also include conflicts involving third parties
e.g. a dispute between the owner of the domain name and a third party
claiming that the registration of the domain name represents an
infringement of his/hers rights. Further, it is proposed to authorise
NORID (Administrator of the top level domain '.no') to withdraw a
registered domain name. The working group has proposed a regulation

Hong Kong Government Proposing to Ban Internet Gambling (New Malaysia
Free Press)
The Sing Tao newspaper reports that ‘Online betting and bookmaking
could be outlawed and included in gambling law, if proposals
suggested by government officials in the Legislative Council
yesterday are adopted.’ In discussions held April 2, it was proposed
that off-shore bookmaking be made illegal as well. Stephen Fisher,
Deputy Secretary for Home Affairs, said that, ‘Under the proposed law
change, any local citizens involved in betting or bookmaking
activities on the Internet would be breaking the law.’ Even existing,
legal off-shore bookmaking companies would face prosecution if
accepting bets through the Internet from players in Hong Kong.

Racist E-Mail Gives Grounds For Dismissal
The city court of Lyngby has found that a company was justified in
dismissing an employee because of an e-mail which could be construed
as racist. It contained a satiric application form for a resident
permit. The employee's name and the company's name were listed as
senders. When the company became aware of the content, the company
dismissed the employee with immediate effect. It is stated in the
company's guidelines that employees are not allowed to send e-mails
with a racist content. Please note this was incorrectly reported as a
German ruling in last week's alert, we apologize for any confusion.

New Internet Related Crimes
As of April 1 2002, the Criminal Code has been supplemented with the
following computer related crimes: (i) unauthorized entry into a
computer system (a hacker attack), (ii) unauthorized modification or
making inaccessible of computer data (e.g., the unauthorized
modification of a website), (iii) obstruction of the operation of a
computer system (e.g., through a virus attack aiming at the freezing
of the system), (iv) possession or offering through a computer system
of pornographic pictures of minors. The crimes at (i) through (iii)
will be punishable regardless of whether any damage was caused or any
profits were made as a result of these crimes. Perpetrators of the
crime at (iv) will be punishable with maximum 8 years, and of the
other crimes with maximum two years imprisonment. 

Cybersmut and Debt Undermine Penthouse (NY Times)
Bob Guccione, the publisher of Penthouse, fought for decades to
introduce pornography to mainstream audiences. In succeeding, he may
have built a gallows for his once hugely successful magazine.
Pornographic images of every bent are now just a click away on the
Web, often at no charge, and Penthouse, which once sold almost five
million copies a month, now has a circulation of 650,000.
